On July 28, 2025, the New York Office of Cannabis Management (OCM) issued a notice amending how it will assess the distance between retail dispensaries and schools to comply with Cannabis Law §72(6). The distance will now be calculated from the dispensary’s main entrance to the nearest property line of a school’s ground.

As a result, approximately 105 licensed dispensaries and 47 retail applicants received notifications from OCM that they do not comply with the distance requirement. Applicants must relocate and licensed dispensaries must either relocate or await the passage of proposed legislation allowing them to remain, which is not a guarantee.
