The proposed mixed-use development offering at 92–100 Calvert Street in Harrison has cleared another significant hurdle. This project will comprise a 3-story building with 14 units, ground-level commercial space, 22 on-site parking spaces, and open space.
New York State Supreme Court Justice Anne Bianchi upheld the Harrison Zoning Board of Appeals’ (ZBA) approval of the multiple Area Variances needed for the project, rejecting challenges brought by opponents in an Article 78 proceeding.
In her decision, Justice Bianchi found that the ZBA’s determination was supported by the substantial evidence put together at the direction of Cuddy & Feder, including expert studies showing limited traffic and school impacts, enhanced flood mitigation measures, and a design that fits within the character of the surrounding neighborhood. The Court also found that many of the objections raised by opponents were speculative and were not supported by the application’s record.
The project owners, 92 Calvert LLC and 100 Calvert LLC, are represented by Cuddy & Feder attorneys Anthony B. Gioffre III, Brendan Goodhouse, and Maximillian Mahalek. Their successful defense of the ZBA approval marks another important milestone in developing a distressed site along Calvert Street.
