Cuddy & Feder LLP Successfully Defeats Challenges to Client’s Complaint Alleging Breach of Contract and Fraud
Cuddy & Feder's litigation team, led by Joshua Kimerling and Seth Pavsner, recently secured a victory for its client, the plaintiff in a case in the Commercial Division of the New York Supreme Court, Westchester County. The Court denied the defendants’ motions to dismiss the complaint alleging breach of indemnification obligations contained in a services contract with a human resources provider and fraud committed by one of the plaintiff’s former officers. The suit arose out of wrongful actions taken by the defendants that caused the plaintiff to be sued for discrimination in a prior case. The meritless discrimination suit was ultimately dropped, but not before Cuddy & Feder’s client was forced to expend substantial funds defending itself against those baseless claims on account of the defendants’ actions.
