Client Advisory: New York to Open Adult-Use Cannabis Nursery License Applications November 5
On October 1, 2026, the New York State Cannabis Control Board approved the application for adult-use cannabis nursery licenses, creating a new licensing opportunity in New York’s cannabis market.
Applications are scheduled to open on November 5, 2026. Unlike many previous cannabis licensing windows, however, this one is particularly short: the application window will close once the Office of Cannabis Management receives the first 50 applications.
Under New York’s Cannabis Law, an adult-use nursery license allows a licensee to produce, sell, and distribute clones, immature plants, seeds, and other agricultural products used specifically for the planting, propagation, and cultivation of cannabis by licensed adult-use cultivators, cooperatives, collectives, and microbusinesses.
The 50-application limit makes advanced preparation especially important. Businesses that intend to apply should use the time before November 5 to understand the licensing requirements, regulatory limitations and assemble the necessary application materials so they are prepared to submit a complete application on November 5.
