Successful Motion to Dismiss: Resolving Claims and Pursuing Counterclaims for Compensatory and Punitive Damages

Our litigation attorneys achieved a significant victory by winning a motion to dismiss. This successful motion eliminated the majority of the plaintiff's claims against our client. As a result, the plaintiff voluntarily withdrew the remaining claims with prejudice. However, our client is pursuing counterclaims for private nuisance and violation of the NY Civil Rights Law, seeking both compensatory and punitive damages in response to the withdrawn claims.
