Troy joined Cuddy & Feder as a summer associate in 2011, became a Litigation Associate in 2012 and was named Partner in 2021. An experienced litigation lawyer, Troy’s diverse practice involves representing individuals, business owners and corporate executives in complex civil and commercial litigation, contract and partnership/shareholder lawsuits, real estate, title and land use litigation, and trusts and estates matters.
Clients praise Troy for his attention to detail and ability to craft pragmatic solutions to their important legal issues and questions. Troy values his role in supporting his clients as a trusted advisor and helping them resolve disputes either through negotiated settlements, and if necessary, through litigation in state and federal court.
As a litigator, one of Troy’s critical functions is counseling clients on how to avoid litigation in the first place through strategic case assessment and planning. By doing this, Troy has been successful in resolving his clients’ matters in less time and without sacrificing results. When litigating cases, Troy’s ability to identify weaknesses in his adversaries’ cases, coupled with his thorough knowledge of the law, has resulted in a track record of success.

Selected Matters
- Successfully obtained the dismissal of a constructive trust claim asserted against their client following the purchase of approximately 84 acres of land in Dutchess County, New York. In the lawsuit, the plaintiff had claimed that he was entitled to a constructive trust over approximately ten acres of the land pursuant to a prior agreement with his deceased father. In dismissing plaintiff’s constructive trust claim, the Supreme Court, Dutchess County, agreed with Cuddy & Feder’s argument that the plaintiff had waived rights to the land based on a Consent to Probate executed by the plaintiff years earlier in connection with his father’s estate.
- In a mortgage foreclosure action, we successfully vacated a competing lender’s default foreclosure judgment obtained against our client’s predecessor by arguing that the competing lender failed to comply with certain statutory notice of pendency requirements and that the foreclosure judgment improperly sought to foreclose on a spouse’s 50% interest in the subject property that it did not have a lien against.
- Successfully represented a former tenant’s claim against our client, the landlord, for over $4 million for breach of lease and negligence. In response to the tenant’s complaint, we counterclaimed for rent and possession of the premises, the latter of which was granted to us in 2015. Thereafter, in October 2016 we moved for summary judgment dismissing all of the tenant’s claims against our client on the basis of certain provisions in the lease. In January of this year, the Court agreed with our reasoning in its entirety and dismissed all of the tenant’s claims against our client and ordered the parties to appear for a settlement conference at which Josh and I secured a settlement of $100,000.00 for our client on our counterclaims for unpaid rent.
