  • Representation of developer of mid-city office park, including land acquisition, zoning and planning, environmental analysis and compliance for structures in excess of 300,000 square feet of mixed office and retail space.
  • Representation of an international developer, owner and manager of large commercial real estate properties in the assemblage and redevelopment of a major downtown project in New York City.
  • Representation of a shared pair REIT in its consideration of a new headquarters site in Westchester County, including a zoning analysis of the site, identification of discrepancies between the original approvals and the actual building and site improvements, negotiations with the municipality and obtaining a resolution from the community board confirming that the building and improvements are deemed to conform to the then controlling zoning and building requirements, thereby allowing the client to proceed with the acquisition without fear of zoning non-compliance.
  • Representation of a New York City based real estate development group in the land use processing necessary to obtain approvals needed to develop a 40 acre site formerly used for medical research in an upscale Westchester community. Despite over 13 acres of delineated wetlands, approvals were obtained for 38 single family homes being sold for up to $1,300,000 each.
  • Representation of a national developer in the redevelopment of an up-scale shopping center in suburban New York, including land acquisition, land use, planning, major tenant leasing and financing, including industrial development revenue bonds.
  • Representation of major developers in urban renewal projects throughout the Northeast.

Industrial Development Agency Financing back to top

  • Representation of client in connection with purchase of 2,500,000 square foot light industrial site with financing assistance in excess of $50,000,000 by issuance of industrial development revenue bonds in Ulster County, New York.
  • Representation of New York City based developer in obtaining inducement from County of Westchester Industrial Development Agency for the issuance of over $127,000,000 in taxable industrial revenue bonds in connection with the acquisition, remediation and development of a complex to be located in White Plains, New York. Obtained 100% abatement for mortgage and sales tax and significant abatement of project real estate tax.
  • Representation of not-for-profit corporation in the acquisition of its headquarters facility financed by industrial development revenue bonds in excess of $3,000,000.
  • Representation of numerous not-for-profit entities (e.g.: YMCA, school for special needs children, social services agency, boys & girls club, historic building site, music conservancy, in-school student anti-substance abuse agency and the like) in tax-exempt bond financings, the proceeds of which were used to defray a portion or all of the costs of property acquisition, hazardous materials remediation, building renovation and equipment purchases.
  • Representation of numerous manufacturers in connection with IRB financing, such as manufacturer of small tools, manufacturer of stamped miniature electrical components, manufacturer of stamped large commercial components, commercial printing, manufacturer of health and beauty aids, manufacturer of infusion molded plastic containers, all in connection with tax exempt or partially tax exempt industrial revenue bond financings.
  • Representation of New York City developer in connection with refinancing for remediation of asbestos and rehabilitation of building complex.

  • Conducted environmental due diligence and prepared environmental representations and warranties for the seller in the acquisition of a chain of gas stations by a large multinational oil company.  
  • Represented a municipality in a multiparty complex environmental litigation, involving Federal, State and common law causes of action, including Superfund, RCRA, and private nuisance, trespass and stigma damage.
  • Acted as the arbitrator in a multi-million dollar dispute involving complex environmental, contract and indemnification issues.
  • Conducted an environmental and liability analysis of properties to be purchased in an abandoned oil field for a major independent oil and gas company.
  • Prepared insurance claims and supervised the environmental investigation and contacts with New York State DEC for an environmental condition on a large office complex in Westchester County.
  • Represented a Florida corporation in investigating and remediating a major solvent chemical spill and negotiating an appropriate consent order with State and local environmental authorities.
  • Represented a client in the investigation of problems necessitating remediation and reconstruction of its waste water treatment plant.

  • Tax certiorari proceedings involving approximately 40 different office building and industrial sites in Westchester County for a single client resulting in an omnibus settlement with payment to client of over $1,000,000.
  • Representation of developers in connection with numerous land use related litigations, including litigation regarding the State Environmental Quality Review Act.
  • Representation of a client against a zoning board based upon a finding by it, ultimately found to be arbitrary and capricious.
  • Representation of a land owner in connection with alleged pollution of real property previously sold to a third party.
  • Representation of a major land owner against a municipality which had illegally dumped construction waste on client's property across the street from client's home, resulting in a recovery of in excess of $700,000.
  • Representation of owner of land against municipality for de facto condemnation by regulatory means resulting in a payment to the client of over $10,000,000.
  • Representation of mail processing company in successful multi-million dollar Breach of Contract jury trial against nationally known Fortune 500 company.
